The short answer
Agree factual questions, entities, relevant dates, lawful sources, contact permissions and preservation requirements. Deliver source-traceable findings and explicit inferences; leave privilege, admissibility, enforceability and recovery strategy to counsel.
Turn the legal issue into a factual instruction.
Distinguish a client assertion, an established fact and a hypothesis. “Find assets” is less useful than “identify recorded interests linking the debtor to the named Brazilian company during this period.” A transaction inquiry might instead ask who authorized a letter or whether an offshore seller had a supported relationship with a Brazilian producer.
State the intended use: transaction assessment, pre-litigation analysis, proceedings or enforcement planning. That affects preservation, translation, source copies and reporting requirements. Identify the decision deadline and the facts whose absence would matter. A broad company profile can be well researched and still fail to answer counsel’s specific evidentiary question.

Resolve identities and chronology before relationships.
Use exact legal names and identifiers, with former names and original-language records where relevant. CNPJ is a Brazilian identity starting point; the competent registry may hold filed corporate acts needed for appointments, amendments or historical ownership questions. The current record should not be made to describe an earlier period without support.
For individuals, collect only relevant information through lawful sources and resolve common-name ambiguity before attributing a record. Distinguish professional history, registered roles and asserted influence. A shared address or director can justify another inquiry without proving common control or responsibility for another entity’s conduct.
Build an evidence register counsel can interrogate.
Link every material finding to the original source where accessible. Record the issuing body, record identifier, retrieval date, relevant historical date and any translation. Distinguish a registry document from a derivative database result and a court allegation from a finding. State coverage limits where proceedings are restricted, incompletely indexed or outside the searches performed.
Preserve source files and provenance according to counsel’s protocol; work from copies when annotating or translating. Where useful, a file hash can help track whether a copy changed, but it does not establish that the original content is true or legally admissible. Avoid making a technically tidy collection sound like an evidentiary ruling.
On a small screen, scroll the table horizontally to compare columns.
| Item | Record explicitly | Avoid implying |
|---|---|---|
| Official record | Issuer, identifier, relevant date and what is recorded. | That the record establishes facts outside its scope. |
| Third-party response | Question asked, channel, respondent and exact answer. | Broader confirmation than the respondent gave. |
| Allegation | Source, party, procedural position and current status checked. | A final finding or proven misconduct. |
| Investigative inference | Observed facts, reasoning and alternative explanations. | That an inferred link is registered ownership or proven control. |
Separate an asset lead from an enforcement conclusion.
Identify the recorded interest, named holder, source and date. Then state the supported connection to the subject. A corporate interest, a property reference or a mining-process record can be a lead without establishing beneficial ownership, current value or availability for enforcement. ANM’s public systems, for example, address their specific recorded mining context, not a general inventory of recoverable assets.
Counsel should assess title, competing rights, available legal process and the significance of the record in the relevant jurisdiction. A valuer may be needed for economic value. The investigator should not promise access to private bank balances or describe an identified asset as recoverable simply because the subject appears connected to it.
Agree lawful handling before moving personal data across borders.
Map who will collect, receive, store and access the material, and in which jurisdictions. Public availability is not a substitute for a lawful purpose, proportionate collection and appropriate safeguards. Ask privacy counsel to assess the relevant obligations rather than assuming that an investigation label creates an exemption.
Brazil’s ANPD publishes guidance on international-transfer mechanisms under the LGPD. The applicable mechanism, current regulatory position and recipient arrangements should be assessed for the actual transfer. Avoid embedding unnecessary personal identifiers in widely circulated reports; give the people who need supporting evidence an appropriately controlled route to it.
Operationalize contact restrictions and reporting boundaries.
Name the instructing lawyer, authorized reporting recipients and escalation contact. State whether subject contact, third-party approaches or contact with counsel’s client is permitted. Require approval for a change in method, not merely notification after an approach has disclosed the investigation. Agree secure channels before exchanging sensitive material.
Do not assume that counsel’s instruction automatically creates privilege or admissibility. Those are legal questions for the jurisdictions involved. Report facts, interpretations and limitations distinctly, with proposed next inquiries tied to the unresolved propositions. The value of the work is a clearer factual record for counsel, not competition with legal strategy or a prediction of litigation success.
